Colorfuldogs (201) 401-9498 Colorfuldogs@gmail.com Terms and Conditions The Parties hereto agree to the following: 1. Colorfuldogs Definition: The term Colorfuldogs as used in this contract refers to the owners, employees, and free contractors of the company known as Colorfuldogs and its authorized representatives. 2. Definition of Services: Colorfuldogs agrees to make every reasonable effort to perform all services requested by client. These services include but are not limited to the following activities: Providing food and water for any pets belonging to the client, taking the client’s pet outside on a leash as directed by the client for the purpose of relieving themselves and/or exercising, cleaning up any visible mess created by the client’s pet(s), and collecting mail, packages, and newspapers belonging to the client and leaving these items in the client’s home. 3. Confirmation of Pet-Sitting Services: When Colorfuldogs is contracted to pet-sit while the client is out of town, Colorfuldogs agrees to make a reasonable effort to reach the client prior to their departure in order to confirm travel plans and verify service dates. In the event that Colorfuldogs cannot reach the client, the client agrees to contact Colorfuldogs prior to their departure in order to confirm. Payment for these services is required before the clients departure. 4. Payment of Fees for Services: Client agrees to pay Colorfuldogs the total fee for the services rendered in full each week. A credit card must be kept on file for every client. In the event the client does not leave cash or check at the end of the service week an invoice will be sent and the credit card charged for the week. A service fee will be applied to all returned checks in the amount of $25 (twenty-five dollars). Regarding dog walking: Payment is due the last day of each week the client receives a walk. Failure to pay on time may result in a $5 additional fee. If a client fails to pay two weeks in a row or more Colorfuldogs reserves the right to suspend services until the balance is paid in full. 5. Cancellations: During non-holidays, an advance of at least 24 hours prior to the scheduled service start date is required for all cancellations. During Holidays, advanced notice of at least four days prior to the scheduled service start date is required for cancellations. Holidays are considered New Year’s Day, Memorial Day, Labor Day, Christmas, and Thanksgiving. PLEASE NOTE: If you need a walk on one of these holidays you MUST schedule it in advance. For cancellations received with less than the required notice, a 50% (fifty percent) refund will be given. No refunds can be given once the services have commenced (e.g. if the client returns home early). In the case of dog walks, a 24-hour period of time is required for cancellations. 6. Authorizations: This contract authorizes Colorfuldogs to enter the client’s home in order to provide pet care and/or services herein. 7. Keys: Client agrees to provide Colorfuldogs with two sets of keys used to enter client’s residence for the express purpose of preforming the services as defined within this contact. Colorfuldogs will make every reasonable effort to store the keys and any identifying information in a safe manner. Addresses will not be printed on client’s keys. 8. Security of Residence: Client expressly agrees to lock all windows, screens, and doors prior to departure. Client agrees to notify Jessica Nearhoof (Owner of Colorfuldogs) at the time services are booked if any person or persons will have access to the residence during the service period. In the event that Colorfuldogs does not have sole control of the client’s home during the period in which services have been booked, Colorfuldogs assumes no liability for any breaches of security, theft, damage to home or pet(s). 9. Relinquishing Claims: Colorfuldogs agrees to provide services stated herein in a reliable and trustworthy manner. In consideration of these services, and as express condition thereof, the client expressly waves and relinquishes any and all claims against Colorfuldogs unless arising from deliberate negligence on the part of Colorfuldogs or their representatives. Colorfuldogs cannot be held responsible for any mishaps, damage, or injury to the client’s pets, home or property, and/or neighbor’s home or property arising from the unpredictable or destructive behavior of client’s pet(s). 10. Unsecured Pets: Colorfuldogs cannot be held responsible for free-roaming outdoor pets in the event of illness, injury, loss or death. Colorfuldogs strongly recommends that all pets remain inside client’s residence or safely confined to an outside area with shelter, and further recommends that all pets wear an ID tag inscribed with a contact number. Invisible fences are not considered safe confinement. 11. Illness of Client’s Pet(s): If client’s pet becomes ill while under the care of Colorfuldogs, client authorizes Colorfuldogs to transport the pet(s) to client’s preferred veterinarian, or to an alternate veterinarian chosen by Colorfuldogs, if client’s preferred vet is not available. Client authorizes Colorfuldogs to approve any emergency treatment recommended by the veterinarian treating client’s pet when the cost of treatment is within the limits of the veterinarian release form. Client further agrees to promptly reimburse Colorfuldogs for any expenses incurred for emergency treatment and to reimburse Colorfuldogs at the hourly rate of $25 (twenty-five dollars) for any additional time required for handling emergencies. Client releases Colorfuldogs from any and all liability related to transportation, treatment, and expense resulting from emergencies. 12. Alternate Care: In the event of personal emergency, illness, incompatibility, or unforeseen unavailability on the part of Colorfuldogs, client authorizes Colorfuldogs to arrange for another qualified individual to fulfill the responsibilities set forth in this contract, or to arrange for alternate care of client’s pet(s). 13. Notification of Return Home: Client agrees to notify Colorfuldogs via email or phone of their return home upon arrival. Client agrees to pay Colorfuldogs the regular per visit rate if additional visits are made due to client’s failing to notify Colorfuldogs of their return home. 14. Delay in Returning Home: If client is delayed in returning home, client agrees to notify Colorfuldogs of such delay as soon as practical, and agrees to pay Colorfuldogs for any additional visits required until their return. 15. Contract Termination: This contract shall remain in effect until either Colorfuldogs or client gives notice of their intent to cancel the contract, in which case such cancellation shall take effect immediately upon completion or cancellation of the last scheduled visit. Client fully understands the contents of this contract and agrees to pre-pay the total fees for services as stated herein, and to pay any additional charges due when services have been completed. In the event that any part of this contract shall be determined invalid, it shall have no bearing on any other part of this contract.
